Federal rescheduling and DEA registration
Marijuana has been rescheduled to Schedule III for state-licensed medical operations. Holders of qualifying state medical marijuana licenses may apply for DEA registration under 21 CFR § 1301.13(k). Applications filed within the 60-day priority window receive a six-month processing target plus lawful-operation protection during DEA review. Section 280E tax disallowance no longer applies to qualifying state medical licensees.
